FTHB Credit Amendments - 11/11/09 at 1:14 PM

Anyone got a refund back on Amending 2008 return to get credit on house purchased in 2009? We did several in late summer/early fall and haven't heard anything back. Then last week a lady who had her return prepared elsewhere, the amendment was dated April 22, 2009, received a letter from the IRS requesting a copy of her settlement statement. The letter was dated October 7, 2009. It took almost six months to even request more information. We have been attaching closing statements with our amendments. Wondering what other preparers are experiencing here. Maybe it's better to file on 2009 return at this point?

The IRS has found it necessary to review this credit more carefully. But six months is pretty fast for processing amendments anyway.

You may have noticed a popular political push over the last twenty years to reduce government services. So be careful what you ask for--you just might get it!

Lien-Holder Prep of 1040X - 11/12/09 at 9:51 AM

Have neighbor (not my client) that told me they purchased a new home. In regards to the down payment and closing costs, the state of Texas has set up a special fund for first time homebuyers where they are advancing up to 8,000 for such use. All loans originated thru this program

come with a second-lien. From what they say, it appears they qualify for the 8,000 credit. Anyway, instead of them going to their tax preparer to ascertain eligibility and to prepare the 1040X, would you believe they signed a POA for the lien-holder to prepare the 1040X. They further stated that the lien-holder wants the 8,000 sent to them; they'll keep whats owed to them (around 6000.)and then send balance to taxpayer. Wonder if IRS will accept this request?

Anybody hand any experience with such?

UPDATE ON MY PREVIOUS POST: I was informed by my neighbor that the lien-holder did the 1040X on the 29th of Aug 09 and they received the 8000.00 (not the lien holder) on the 13th of Nov. 76 days - wow, thats a record for 1040x response. Very interesting, huh!!!!

Did 2 amended returns for the FTHBC in May and June, supplied closing doc's with them, got the $8k within 4 weeks. Maybe it is getting slower because of the numerous fraudulent returns received by the IRS.
